Overview

Retail and marketing teams adopt AI quickly for chat, personalisation, pricing and content. Most of these uses carry lower legal risk than hiring or credit, but consumer protection, advertising and privacy rules still apply, and a wrong or manipulative output damages trust quickly.

What to do now

Questions to ask

  • Do customers know when they are talking to AI, and can they reach a person?
  • Do we label generated images, video or ads where required or expected?
  • Could personalised pricing or targeting treat groups unfairly?
  • What customer data goes into prompts and third-party tools?
  • Who checks claims in generated copy before it is published?

Common mistakes

  • Letting a bot state refund or price terms.
  • No handover to a person.
